Terms of Service
Last updated: August 22, 2026
These Terms of Service ("Terms") govern your access to and use of the websites, applications, platforms, products, and services provided or operated by CHEFU TECHNOLOGIES (Pty) Ltd. ("CHEFU TECHNOLOGIES", "we", "us", or "our").
By accessing or using a CHEFU TECHNOLOGIES service, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the relevant service.
These Terms apply to visitors, customers, registered users, and other persons who access or use a CHEFU TECHNOLOGIES service, except where a separate written agreement expressly governs a particular service or transaction.
1. About CHEFU TECHNOLOGIES
CHEFU TECHNOLOGIES (Pty) Ltd. is a South African technology company that develops and provides digital products, software, websites, applications, technology services, and related solutions.
Our primary website is available at chefu.co.za.
The particular products, features, functionality, and services available through CHEFU TECHNOLOGIES may change over time. Certain services may also have additional terms that apply specifically to those services.
2. Acceptance of These Terms
By accessing or using a CHEFU TECHNOLOGIES service, you confirm that you have read, understood, and agree to these Terms and any additional terms that are expressly incorporated into them.
If you are using a CHEFU TECHNOLOGIES service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not have the legal capacity to enter into a binding agreement under applicable law, you may only use the service with the involvement and authorization of a parent, guardian, or other legally authorized person where required.
3. Changes to the Services
We may add, modify, suspend, or discontinue features or portions of a CHEFU TECHNOLOGIES service from time to time.
Changes may be necessary to improve functionality, maintain security, respond to technical requirements, comply with law, address abuse, or otherwise operate our business.
We do not guarantee that every feature or service will remain available indefinitely.
4. User Accounts
Certain CHEFU TECHNOLOGIES services may require you to create an account or authenticate before accessing particular features.
You are responsible for providing information that is accurate and reasonably up to date when creating or maintaining an account.
You are also responsible for maintaining the security of your account and for activity performed through your account, except to the extent that applicable law provides otherwise.
You must notify us promptly if you believe that your account, authentication credentials, or device has been compromised or accessed without authorization.
5. Authentication and Passkeys
Some CHEFU TECHNOLOGIES services may support authentication methods including email authentication, supported identity providers, single sign-on, and passkey-based authentication.
When using a passkey, the private credential associated with the passkey is generally protected by the device, operating system, or credential manager used to create it. You remain responsible for securing the device and authentication mechanisms used to access your account.
We may suspend or require additional verification for an account where we reasonably believe that unauthorized access, fraud, abuse, or another security risk has occurred.
6. Acceptable Use
You agree to use CHEFU TECHNOLOGIES services only for lawful purposes and in a manner that does not interfere with the operation, security, or availability of the services.
You must not, where applicable:
- Use a service for unlawful, fraudulent, or malicious purposes.
- Attempt to gain unauthorized access to accounts, systems, infrastructure, or data.
- Interfere with or disrupt the operation of a service.
- Attempt to bypass security controls, authentication mechanisms, or usage restrictions.
- Introduce malware, malicious code, or other harmful material.
- Probe, scan, or test systems for vulnerabilities without authorization.
- Use automated systems to access a service in a manner that places unreasonable load on the service or bypasses applicable restrictions.
- Impersonate another person, business, or organization.
- Use a service to violate another person's rights.
- Upload or transmit content that you do not have the right to use.
- Attempt to reverse engineer, decompile, or otherwise derive source code from software where prohibited by applicable law.
- Use a service to facilitate activity that is prohibited by applicable law.
7. User Content
Certain CHEFU TECHNOLOGIES services may allow you to submit, upload, store, or otherwise provide content such as text, images, files, documents, or other information ("User Content").
You retain ownership of User Content to the extent that you originally own the applicable rights.
By submitting User Content to a service, you grant CHEFU TECHNOLOGIES the limited rights reasonably necessary to host, process, transmit, display, store, or otherwise use that content to provide the service you requested.
You represent that you have the rights and permissions necessary for any User Content that you submit and that your submission of that content does not unlawfully infringe another person's rights.
We may remove or restrict User Content where reasonably necessary to comply with law, protect users, address security issues, enforce these Terms, or operate the relevant service.
8. Intellectual Property
Unless expressly stated otherwise, the CHEFU TECHNOLOGIES services and their software, source code, design, interfaces, visual elements, text, graphics, logos, trademarks, service marks, documentation, and other original materials are owned by or licensed to CHEFU TECHNOLOGIES.
Nothing in these Terms transfers ownership of CHEFU TECHNOLOGIES' intellectual property to you.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the relevant service for its intended purpose.
You may not reproduce, distribute, modify, sell, license, publicly display, or create derivative works from CHEFU TECHNOLOGIES intellectual property except where expressly permitted by us or applicable law.
9. Trademarks and Branding
CHEFU TECHNOLOGIES, associated logos, names, branding, and other marks may constitute trademarks or other protected intellectual property.
You may not use our trademarks or branding in a way that suggests an unauthorized affiliation, sponsorship, endorsement, or partnership.
10. Third-Party Services
CHEFU TECHNOLOGIES services may integrate with or depend on third-party platforms, infrastructure, authentication providers, payment providers, hosting providers, storage services, APIs, or other external services.
Third-party services may be subject to separate terms and privacy policies. Your use of those services may therefore be governed by agreements between you and the relevant third party.
We are not responsible for third-party services that we do not control, including their availability, content, security, policies, or functionality.
11. External Links
Our services may contain links to websites, applications, or resources operated by third parties.
A link does not necessarily mean that CHEFU TECHNOLOGIES endorses or is affiliated with the linked service.
We do not control third-party websites and are not responsible for their content, security, privacy practices, availability, or services.
12. Payments and Purchases
Where a CHEFU TECHNOLOGIES service allows you to purchase products or services, additional pricing, payment, delivery, refund, cancellation, or transaction terms may apply.
Prices, descriptions, availability, and other commercial information may change from time to time. Where required by applicable law, applicable consumer-protection rights will continue to apply regardless of these Terms.
Payments may be processed through third-party payment providers. Those providers may process payment information in accordance with their own terms and privacy policies.
13. Availability and Service Reliability
We aim to keep our services available and reliable, but we do not guarantee uninterrupted or error-free operation.
Services may occasionally become unavailable because of maintenance, upgrades, infrastructure failures, security incidents, third-party outages, network problems, or circumstances outside our reasonable control.
We may temporarily restrict access where necessary to protect the service, users, infrastructure, or information.
14. No Professional Advice
Unless expressly stated otherwise, information made available through CHEFU TECHNOLOGIES services is provided for general informational or functional purposes and should not automatically be treated as professional, legal, financial, medical, or other regulated advice.
You are responsible for obtaining appropriate professional advice where your circumstances require it.
15. Disclaimers
To the maximum extent permitted by applicable law, CHEFU TECHNOLOGIES services are provided on an "as is" and "as available" basis.
We do not guarantee that a service will always meet every particular requirement, operate without interruption, be completely secure, or be free from errors.
Nothing in these Terms excludes or limits a right, warranty, condition, or remedy that cannot lawfully be excluded or limited under applicable law.
16. Limitation of Liability
To the maximum extent permitted by applicable law, CHEFU TECHNOLOGIES will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or relating to the use of, or inability to use, a CHEFU TECHNOLOGIES service.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot lawfully be excluded or limited under applicable consumer-protection or other mandatory legal requirements.
17. Indemnity
To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful use of a CHEFU TECHNOLOGIES service, your violation of these Terms, or your infringement of another person's rights through content or activity you submit or undertake through the service.
This provision does not require you to indemnify us for matters caused by our own unlawful conduct or where such an obligation is prohibited by applicable law.
18. Suspension and Termination
We may suspend, restrict, or terminate access to a CHEFU TECHNOLOGIES service where reasonably necessary, including where we believe that:
- You have materially breached these Terms.
- Your activity creates a security or operational risk.
- Your account is involved in fraud, abuse, or unauthorized activity.
- Suspension is necessary to comply with law or a valid legal request.
- The relevant service is discontinued.
Where appropriate and reasonably practicable, we may provide notice before taking action. Immediate action may be necessary where security, fraud, abuse, legal, or other urgent circumstances require it.
Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, and dispute-related matters.
19. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using a service, you acknowledge that you have had an opportunity to review the applicable Privacy Policy. Our privacy practices are subject to applicable data-protection laws and the terms described in the Privacy Policy.
20. South African Law and Consumer Rights
CHEFU TECHNOLOGIES operates in South Africa. These Terms are intended to operate consistently with applicable South African law, including applicable consumer-protection and electronic communications legislation.
Nothing in these Terms is intended to remove, restrict, or waive a statutory right that cannot lawfully be excluded, restricted, or waived.
Where applicable, consumers retain rights provided to them under mandatory South African consumer-protection law.
21. Governing Law
Subject to any mandatory legal rights or requirements that apply to you, these Terms are governed by the laws of the Republic of South Africa.
Any dispute arising from or relating to these Terms will be subject to the jurisdiction of the appropriate courts of South Africa, subject to any mandatory jurisdictional or consumer-protection rights that may apply.
22. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date displayed at the beginning of this page.
Where required by applicable law, we will provide additional notice or obtain any required consent before material changes become effective.
Your continued use of a service after revised Terms become effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.
23. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally possible.
If it cannot be made enforceable, the affected provision will be severed to the extent necessary, and the remaining provisions will continue in effect.
24. No Waiver
Our failure to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.
25. Entire Agreement
These Terms, together with any additional terms expressly incorporated into them and any applicable service-specific agreements, constitute the agreement between you and CHEFU TECHNOLOGIES concerning your use of the relevant service, except where a separate written agreement expressly governs.
